TERMS AND CONDITIONS OF USE

By signing up for a CrowdRising membership, you agree to the following Terms, Conditions and Disclaimers:

 

In order to have a position on the CrowdRising.net platform, you MUST have a membership with the Parent company, The Team Phoenix Transformation, LLC. The Team Phoenix Transformation, LLC is a free membership for as long as you are a member. There are many benefits to becoming a member, the most evident is the ability to create multiple streams of residual income. There are NO requirements to join any other opportunity than CrowdRising, but you will always have that option.

This service is provided on an As Is, as available service. We make no warranties of any kind, either expressed or implied. And that you understand that specific guidelines and policies are in place to protect all members, including the admin.

 

  1. You agree to take appropriate action when you receive a notification of a donation known as "Pending Donations" and you understand that failing to take action (either Approve the pending donation if the payment was received or Decline if the donation was not received) within 24 hours from receiving a pending donation will cause the system to suspend your account and completely disqualify you from any further donations. You will remain suspended until you contact support having resolved the issue of an Approved or Declined donation and request your account to be "Reinstated".
  2. You also understand that you have a full 48 hours from the time you join CrowdRising to decide if you wish to participate or not. Failing to Step-up will cause the system to delete your account. Step-up is making a $20 donation when you start. You are welcome to join again and get a second 48-hour period to decide to participate, failing to participate a second time will get you banned from joining the CrowdRising community again.
  3. You have read and understood that "Spamming" and/or cross-recruiting means contacting other participants in an attempt to promote ANY other opportunity to ANY fellow CrowdRising participants is grounds for "Immediate" account suspension which disqualifies you from receiving spillover, new sign-ups as well as donations.
  4. Under no circumstances, including negligence, shall anyone involved in creating, producing or distributing this service, be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or inability to use this service, and all the files and software contained within it, including, but not limited to, reliance on any information obtained through this service; or that result from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation, or transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to our records, programs or services.
  5. We reserve the right to add or remove features and modify any functionality, make changes on how the platform works, manage memberships, within CrowdRising, and otherwise make changes to the service and this agreement without notice.
  6. We may terminate without notice, at our sole discretion, any membership deemed to be in breach of this agreement or otherwise found to be abusing or misusing the service, or harassing the other members or administrator in any way.
  7. In the unlikely event that this program should ever terminate, its owner(s), operations, its creator, operators, employees, assigns and successors shall not be held liable for any loss whatsoever to our members.
  8. Sites and individuals involved with the following activities are NOT ELIGIBLE: selling, providing or linking to unlicensed content, pornography, warez, pirated software, hacking or spamming software, email address lists or harvesting software, or any materials endorsing violence, hatred, revenge, racism, victimization, or criminal activity.

      Members Genealogy position / account will be immediately terminated for the following type  of advertisement: selling, providing or linking to unlicensed content, pornography, hacking or spamming software, or any materials endorsing violence, hatred, revenge, racism, victimization, or criminal activity. CrowdRising at its sole discretion has the final decision on any advertisement.

  1. We make no claims on how many donations you can receive with our program. Your ability to receive donations depends on a number of factors, including where and how (and how often) you advertise the program, and the motivation and ability of those in your community, to make referrals. Individual results will vary.
  2. Members caught spamming or otherwise causing harm to our program will have their accounts terminated and may be prosecuted for their actions. We will investigate all allegations before taking action.
  3. All donations you willingly and directly send to a fellow participant are final. No refunds.
  4. You understand that all donations will be made directly by donors to you through your payment processors, and that any problems you have concerning such matters should be taken up with your respective payment processor’s account provider.
  5. Bitcoin is a mandatory International processor that everyone must have in order to be part of the Team Phoenix / CrowdRising community. If there is a payment processor that works well for your area (country), after YOU have verified that our platform does not violate their terms and agreement and you can use it for your area. But you still must have the International Payment processor (Bitcoin) as part of your options.
  6. If any member decides to use a payment processor that conflicts with a company’s terms and agreements, your account with Team Phoenix and CrowdRising will be subject to termination. Team Phoenix and CrowdRising will continue to have a great business relationship with other organizations / businesses by honoring any terms and agreements that they have for their group.
  7. You agree to accept email updates regarding CrowdRising. We will never inundate you with emails or spam. The Team Phoenix business / CrowdRising platform management will use TrafficWave to communicate to the community.

  1. On the Info & Tutorials page on the CrowdRising website there is information on recommend language. Using language that is not recommended is grounds for removing your account.
  2. No members are allowed to set up any contracts and/or accounts in the CrowdRising name. Any accounts that are authorized to be set up would have to be a Notarized agreement by the owners. Anyone setting up any contracts or accounts without a written Notarized authorization, will be 100% responsible for the contracts and or accounts, they will be terminated from the platform, and prosecuted for fraud to the full extent allowed by applicable law. CrowdRising at its sole discretion and for any or no reason may refuse to accept applications for membership.
  3. CrowdRising shall be the sole determiner in cases of suspected abuse, fraud, or violation of its rules. Any decision CrowdRising makes relating to the cancellation of all Genealogy position(s) and the termination of membership shall be final and binding.
  4. Member's discontinued participation in CrowdRising program or failure to notify CrowdRising of any address (mailing or email) changes may result in the termination of Member's membership. Member shall comply with all laws, rules, and regulations that are applicable to Member. Member acknowledges that Member may only participate in The Team Phoenix Transformation LLC program if and to the extent that such participation is permitted by such laws, rules, and regulations for their physical living area. If member objects to any of the Terms and Conditions of this Agreement, or any subsequent modifications to this agreement, or becomes dissatisfied with the Program, Member's only recourse is to immediately discontinue participation in CrowdRising program and properly terminate his or her membership.
  5. In such as event that CrowdRising decides to terminate its' operations, its Owner, creator, employees, operators, and successors shall not be held liable for any loss whatsoever to our members or affiliates.
  6. Member's role as a member of CrowdRising does not constitute a partnership, or employer / employee relationship, and members are considered independent entities, and therefore you are responsible for your own bookkeeping, taxes, and reporting, where applicable.
  7. Any disputes and / or Lawsuits will be resolved in the county of Spartanburg South Carolina.
  8. The Laws of South Carolina will interpret the contract and any disputes will be handle by the courts of South Carolina.
  9. Indemnification:
    You hereby agree to indemnify and hold harmless "CrowdRising", its subsidiaries and affiliates, and their directors, officers, employees, agents, shareholders, partners, members and other owners, against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, expenses and costs (any or all of the foregoing hereinafter referred to as "Losses") insofar as such Losses (or actions in respect thereof) arise out of or are related to: (i) any claim that your use of the Licensed Materials infringes on any trademark, trade name, service mark, copyright, license, intellectual property, or other proprietary right of any third party, (ii) any misrepresentation of a representation or warranty or breach of a covenant and agreement made by you or on your behalf herein; (iii) the development, operation, maintenance and content of Your Site, and products and services offered from Your Site, or any claim related to Your Site, including, without limitation, content therein not attributable to us; or (iv) any representation or warranty made by You on Your Site or otherwise relating to the Services that exceeds the representations and warranties made by "CrowdRising" regarding such Services. 

 

Disclaimers

  1. MEMBER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT MEMBER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
  2. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER CrowdRising NOR ANY OF ITS MEMBERS, SUBSIDIARIES, PUBLISHERS, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DONATIONS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  3. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, CrowdRising attempts to use appropriate industry standard procedures to safeguard the confidentiality of Member's personal information, such as firewall, encryption, token authentication, application proxies, monitoring technology, and adaptive analysis of the Website's traffic to track abuse of CrowdRising Website and its data. However, no data transmitted over the Internet can be 100% secure. As a result, while CrowdRising strives to protect its Members personal information, CrowdRising cannot guarantee the security of any information that Members transmit to or from the participating advertisers/payment processors and Member does so at his/her own risk. This Agreement constitutes the entire Agreement between Member and CrowdRising in connection with general membership in CrowdRising program and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this AGREEMENT is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of this AGREEMENT will remain in force. No failure of either party to exercise or enforce any of its rights under this AGREEMENT will act as a waiver of such rights.
